Acceptance of Terms

By downloading, installing, accessing, or using Sessions, you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use the app.

Description of Service

Sessions is an indoor cycling and fitness application that allows users to connect to Bluetooth-compatible fitness devices, create and complete custom workout plans, track training history, and access workout recommendations and related features.

Some features of Sessions are available free of charge, while others require an active paid subscription.

Health and Safety Disclaimer

Sessions is not a medical service and does not provide medical advice, diagnosis, or treatment. The information, workouts, and recommendations provided through the app, including AI-generated workouts, are intended for general fitness and informational purposes only.

Before beginning any exercise program, you should consult a qualified healthcare professional, especially if you have any medical condition, injury, heart condition, or other health concern.

You acknowledge that physical exercise involves inherent risks, including the risk of injury, illness, serious bodily harm, or death. You voluntarily assume all risks associated with your use of Sessions, including workouts you create yourself, workouts generated by artificial intelligence, and workouts performed using connected fitness equipment.

You are solely responsible for exercising within your own limits and for stopping exercise immediately if you experience pain, dizziness, discomfort, or other health concerns.

AI-Generated Workouts

Certain features of Sessions may generate workout suggestions or training recommendations automatically using artificial intelligence.

AI-generated workouts may contain errors, inaccuracies, unsuitable intensity levels, or recommendations that are not appropriate for your fitness level, physical condition, equipment, or health status. You are solely responsible for evaluating and adjusting any workout before performing it.

Sessions does not guarantee the safety, effectiveness, or suitability of AI-generated recommendations.

Account Registration

You must create an account to use Sessions. You may register using an email address, Google Sign-In, or Sign in with Apple.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating your account.

You must be at least 13 years of age to use Sessions.

Subscriptions and Billing

Certain features are available exclusively to users with an active Sessions subscription.

Subscriptions are offered on a recurring basis and are billed through the Apple App Store or Google Play Store, depending on your platform. Subscription pricing and billing frequency are displayed before purchase.

You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period.

Refunds are subject to the refund policies of the applicable app store provider.

Third-Party Devices and Services

Sessions may rely on third-party hardware, sensors, smart trainers, operating systems, cloud providers, wireless connectivity, and external services that are outside of our control.

We do not guarantee compatibility, availability, accuracy, or uninterrupted operation with any specific device, sensor, operating system, or third-party service.

We are not responsible for interruptions, connectivity failures, inaccurate sensor readings, data loss, hardware malfunctions, or other issues caused by third-party products or services.

Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble any part of the app.
• Use automated scripts, bots, or unauthorized software to access or interact with the service.
• Attempt to gain unauthorized access to other users' accounts, data, or our infrastructure.
• Use Sessions in any way that violates applicable local, national, or international laws or regulations.
• Transmit any content that is unlawful, harmful, abusive, offensive, fraudulent, or otherwise objectionable.
• Interfere with or disrupt the integrity, security, or performance of the service.

Intellectual Property

Sessions and all related content, features, functionality, branding, design elements, software, and technology are owned by App Sessions or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of the workout data and content you create within the app. By using Sessions, you grant us a limited, non-exclusive license to store, process, transmit, and display your data solely for the purpose of operating, maintaining, and improving the service.

Privacy

Your use of Sessions is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your information.

Disclaimer of Warranties

Sessions is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory.

To the fullest extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and availability.

We do not warrant that the service will be uninterrupted, error-free, secure, accurate, or free of viruses or other harmful components.

Your use of Sessions is at your sole risk.

Limitation of Liability

To the fullest extent permitted by applicable law, App Sessions and its affiliates, licensors, partners, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of data, personal injury, health-related claims, equipment damage, or service interruptions arising out of or related to your use of Sessions.

Our total liability for any claims arising out of or relating to Sessions shall not exceed the total amount paid by you for the service during the twelve (12) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

Termination

You may stop using Sessions at any time and may delete your account directly within the app.

We reserve the right to suspend or terminate your access to Sessions if you violate these Terms, misuse the service, create security risks, engage in fraudulent activity, or otherwise harm other users or the platform.

Upon termination, your personal data will be handled in accordance with our Privacy Policy.

Force Majeure

We are not responsible for delays, interruptions, failures, or inability to provide the service resulting from causes beyond our reasonable control, including natural disasters, internet or infrastructure failures, power outages, labor disputes, governmental actions, cyberattacks, or failures of third-party services or providers.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Brazil, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or the use of Sessions shall be subject to the exclusive jurisdiction of the courts located in Paraná, Brazil.

Changes to Terms

We may update these Terms of Service from time to time.

If we make material changes, we will provide notice through the app, by email, or by other reasonable means before the updated Terms take effect.

Your continued use of Sessions after the effective date of the updated Terms constitutes your acceptance of the revised Terms.
